Purpose:

The phased faculty contract (pfc) is designed to be offered each year beginning when age 65/10 years of DCCCD service is reached, or when the "Rule of 80" is satisfied. The "Rule of 80" is the combination of age and the years of service (including at least 10 years or more of service with the DCCCD).

The pfc is offered as a three-year, nonrenewable contract not to exceed 49 percent of the faculty member's contractual pay for equivalent responsibilities. It is expected that the majority of the phased faculty contracts will include a significant teaching component, but duties might include a combination of credit and noncredit instruction, counseling, program development and other duties as agreed between the faculty member and the division dean or other assigned supervisor.


Background:

The phased faculty contract (pfc) is a program offered to:

a) promote the transitional well-being of long-term faculty moving toward retirement,
b) allow the colleges to project and fill critical faculty positions in a more responsible manner,
c) and produce district cost savings.

Based on state legislative action in 2003, all other DCCCD-sponsored early retirement programs have been cancelled.

Procedures:An employee on a pfc will be required to formally declare themselves "retired" - to be formally accepted by the Board of Trustees, and declared for pension purposes as required by TRS, ORP and ERS. Employee and the district agree that the district does not guarantee any payment of retirement benefits from other retirement sources, such as the Teacher Retirement System, Optional Retirement Plan, Tax-Sheltered Annuity Plan or other similar sources.

An employee on a pfc contract may carry forward as many as fifteen (15) days of accumulated sick leave for use over the life of his/her pfc. 

The salary for an employee on a pfc will be a percentage not to exceed 49 percent of the regular nine-month contract salary in effect during the last year of full-time employment. An employee on a pfc will not be eligible for salary increases during the pfc.

An employee on a pfc contract will not be eligible for performing additional extra service during the fall or spring semesters. Further, as a "retired" employee, there is no "formula" pay as available to full-time faculty.  However, an employee on a pfc contract is eligible to perform extra service duties during the summer (if extra service is available).
Please note that if the pfc employee is a TRS retiree, it is the responsibility of the retiree to determine how much they can work during the summer in order not to jeopardize their annuity.

The pfc is an option for employees paid from the faculty salary schedule only.

A pfc cannot be extended beyond three years but may be vacated by the employee at any point during the three years upon a written request. Such a written request signifies cancellation of the agreement. Additional performance policies and procedures of the district apply during the duration of this phased faculty contract.

Responsibility:
The faculty must complete the following processes for Phased Faculty Retirement:

  1. Complete the Phased Faculty Retirement Participation Acknowledgment Form and return to the location HR office.
  2. Receive in U.S. mail the Phased Faculty Retirement Agreement, sign and return to District HR.
  3. Receive in U.S. mail the Phased Faculty Retirement Contract, sign and return to District HR.
HR Responsibility:The location human resources office will forward the Phased Faculty Retirement Participation Acknowledgment Form to District Human Resources. District Human Resources will prepare the name for the board agenda. District HR generates a Phased Faculty Retirement agreement and mails it to the faculty. Once the agreement is received at District Human Resources, a phased faculty contract is mailed to the faculty member.
