Purpose
This Transfer and Articulation Agreement ("Agreement") is entered into between Southeastern Career Institute ("SCI") and Dallas County Community College District in behalf of El Centro College (hereinafter referred to as "El Centro"), for the purpose of establishing the terms under which students will transfer from the Associate of Applied Science in Paralegal Studies Program at SCI ("SCI Program") to the Associate of Applied Science in Paralegal Studies Program at El Centro ("El Centro Program"). 

Student Eligibility
Students eligible to transfer from the SCI Program to the El Centro Program under this Agreement (the "Eligible Students") shall have:

  • been enrolled in the SCI Program on December 15, 2004;
  • completed less than 75% of the SCI Program by February 17, 2005; and
  • met all relevant admissions requirements of El Centro in place at the time of their application to El Centro.

Education
El Centro agrees to accept all Eligible Students for transfer, and provide those who do transfer (the "Transferring Students") with the necessary instruction, facilities, and supplies to complete their education in the El Centro Program.

Student Records
Subject to any required student consents, SCI agrees to forward to El Centro all student records necessary to effectuate the transfer of Eligible Students under this Agreement, including but not limited to transcripts, proof of graduation, and all documentation related to the Texas Success Initiative (TSI).

El Centro Policies
The Transferring Students shall be subject to the same policies, codes of conduct, procedures, and requirements as other students enrolled at El Centro.

Credit Transferability
El Centro agrees to accept the credits earned by Transferring Students at SCI according to the terms outlined in Exhibit "A" attached hereto and incorporated into this Agreement.

TSI
El Centro will determine the college-readiness of Transferring Students under the TSI, according to the Board’s rules. SCI shall pay the cost of any required TSI testing and remediation, but only to the extent necessary for Transferring Students to meet the TSI requirements.

Student Tuition
SCI agrees to ensure that Transferring Students under this Agreement shall not pay more than their contracted price with SCI in order to complete the El Centro Program. 

Associated Costs
SCI will pay for the cost of instructors teaching Introduction to Law and Legal Research and Writing to Transferring Students during the Spring Semester of 2005. In addition, SCI will pay the tuition and book costs for all Transferring Students enrolling in these courses during the Spring Semester of 2005. El Centro agrees that there are no other associated costs incurred as a result of accepting Eligible Students under this Agreement, and El Centro will not seek reimbursement from SCI for any costs except those described in this Paragraph.

Degrees
Transferring Students will be awarded the Associate of Applied Science in Paralegal Studies Degree from El Centro upon completion of that institution’s degree requirements.

Duration
This agreement is effective as of the date of execution of this Agreement, and will expire on the day that all Transferring Students have either completed or been dropped from the El Centro Program. If either party defaults in the performance of this Agreement or is in breach of a material provision hereof, the other party, at its option, may terminate this Agreement by giving written notice to the breaching party describing the nature of the breach and, to the extent such breach is curable, giving the breaching party thirty-(30) business-days from the sending of this notice to cure the breach. If at the end of the thirty-30-day period the breach has not been cured, this Agreement shall automatically terminate.

All notices, demands, requests, and other communications required shall be in writing and shall be deemed to have been given personally delivered or mailed to:

Signatures
By signing, each party understands the commitment to students transferring from SCI to El Centro, and El Centro agrees that all students transferring to El Centro from SCI as a result of the Texas Higher Education Coordinating Board’s revocation of SCI’s degree authority shall be given every opportunity to complete their degree at El Centro. The foregoing is agreed to and accepted. This Agreement is effective beginning _____ day of ______________, 2005.

Exhibit "A"

ADDITIONAL TERMS AND CONDITIONS

A four quarter-credit hour SCI course equals a three semester-credit hour ECC course.

Regardless of the number of courses and credit hours that could qualify for transfer, any transfer student from SCI must complete at least twenty-five per cent of the coursework at ECC, which is 5 paralegal courses. Included in these five courses is LGLA 2331 – Advanced Legal Research & Writing, a capstone experience, which must be taken to be eligible to receive the AAS degree from ECC.

Only approved courses with a C or better grade will be accepted. Students must meet Texas Success Initiative (TSI) standards and course prerequisite requirements. 

Students must complete 25% of the degree requirements at ECC, maintain a 2.0 GPA and meet all other graduation requirements to earn an AAS degree.
